Supreme Court rules against Kentucky clerk in gay marriage case
Published August 31, 2015 Associated Press

MOREHEAD, Ky. – The Supreme Court on Monday ruled against the Kentucky county clerk who has refused to issue same-sex marriage licenses, and the clerk will arrive at work Tuesday morning to face her moment of truth.

Rowan County Clerk Kim Davis will have to choose whether to issue marriage licenses, defying her Christian conviction, or continue to refuse them, defying a federal judge who could pummel her with fines or order that she be hauled off to jail.

Davis stopped issuing all marriage licenses in the days after the landmark decision. Two gay couples and two straight couples sued her, arguing that she must fulfill her duties as an elected official despite her personal religious faith. A federal judge ordered her to issue the licenses, and an appeals court upheld that decision. Her lawyers with the Liberty Counsel filed a last-ditch appeal to the Supreme Court on Friday, asking that they grant her "asylum for her conscience."

Justice Elena Kagan, who oversees the 6th district, referred Davis' request to the full court, which denied the stay without comment.

  • Do you believe she was right or wrong in refusing to issue licenses?
Does any public employee, or an employee in a public establishment, have the right to refuse service to anyone for "religious reasons"?

Paprika wrote: You admitted that "in and of themselves, there is nothing in your valuations to commend themselves to others" it implies that 'in and of themselves they are worthless'.
But that doesn't take into account the things I can do or say, to convince others to align their own private valuations to mine.
I do, of course, understand that a subjectivist might still wish to imbue such valuations with some subjective conception of 'worth', so do feel free carry on.
You've got that right.

Partial from above:
On Monday, lawyers for two gay couples and two straight couples questioned the validity of the new marriage licenses and asked a federal judge to order Rowan County Clerk Kim Davis' office to reissue them. If she refuses, the lawyers asked the judge to put the office in receivership and have someone else do it.

Davis is prepared to return to jail over her beliefs, according to an interview that aired Tuesday morning on "Good Morning America" — the first she's given since her refusal to issue licenses gained national attention.

"I have never once spouted a word of hate. I have not been hateful," she said. She also said the licenses going out of her office now, issued by a deputy clerk, don't have her authorization and are "not valid in God's eyes."

I hope the judge throws her in jail and fines her directly.

She is (ab)using her government position to enforce her religious beliefs upon the people she is supposed to serve. Unfortunately, she is also allowing herself to BE used by those with a political-religious agenda.

I agree with the couples being upset with the altered marriage licences. Are they supposed to feel secure with something that might not stand as a legal document?

More things like this will happen for at least a while. I think history has shown that changing a law to allow for equal rights is just the first battle, and there are more to come.

Peace.

I'm not in favor of homosexuality or same sex "marriage".
To me it's immoral.
However, the lady is a public servant.
I see no issue for her morality by doing her JOB and disregarding the
sexuality of the couple.
SHE is not performing the ceremony and not living with the couple.
If a clerk issues a drivers license to an alcoholic the clerk is not endorsing
that alcoholic to drive while drunk.

Is having many wives or husbands immoral?
What about sex when not married?
Is oral sex immoral?
What is not immoral when discussing sex? Straight missionary without birth control between a married couple the only moral sex act?

It means there are modern folks who've adopted ancient Hebrew sexual taboos, by divine command. God says it is sinful and so does the Apostle Paul.
