I am a ShapeShifter. I decide to look like Brad Pitt with the intention of me having sex with Angelina Jolie.(Not Brad her husband)

She thinks I am her husband and we have great sex

Is this rape??

You tricked her. It would be rape if she would not have agreed if she had know the truth/had been able to give consent to having sex with YOU.

Yes you are guilty of rape under UK law.

Section 76(2) of the Sexual Offences Act 2003

(Which deals with cases of impersonation)

The leading case is Elbekkay [1995] Crim LR 163 (CA)

(Rather than take a personal moral position, I take the position of the law of the land as it is far more relevant)

By the way you are not a shapeshifter as no such thing exists.

There's no such thing as objective morality. Morality is useful for improving the quality of life for ourselves and people living around us.

So while one isolated incident like this might not harm the person being "raped", if we allow this to become a regular occurrence, it will create a paranoid society in which we don't trust our loved ones and are constantly worried about having sex. Therefor it should be punished as rape.

This could actually become a real issue as we develop better methods of disguise. Scary to contemplate.

I'd certainly consider it a form of rape of false pretences. There may some grey areas if, instead, you were to possess Brad Pitt's body with your (I believe, non-existent) soul and conduct sex that way.

But then you would be guilty of violating Pitt's own sanctity of bodily control, or whatnot.

(b)B does not consent to the penetration, and
(c)A does not reasonably believe that B consents.

If you're going by the law, it wouldn't be rape if the situation were reversed (i.e. a fake Angelina Jolie on a real Brad Pitt). It'd almost certainly still be sexual assault, however.

I'd be less interested in this question and more interested in how in the world did you get shapeshifting capabilities? Going further, how can I get those same abilities?
