Actually my husband and I have. When the Guy that hit my son with a 2x the legal weight load capacity of his vehicle (was found guilty as well), we did not pursue a civil case. What I found most interesting was how many people were amazed that we did not run to the courts for a pay day. Hubby and I opted a wait and see attitude, if my son exhibits long term damage well then we will sue on his behalf as he will need help (obviously). If my son is able to maintain in school, w/o physical repercussions, we will continue to thank God, daily, that he was spared. As angry as we were that he put our baby in PICU, it just didn't feel right to heed the advice that we were given by many. We have no desire to ruin the man and his business, we pray that he learned, and remembers not to overweight his truck ever again.
